Binview Retreat – Terms & Conditions

Welcome to Binview Retreat. By making a booking, attending an event or using our facilities, you agree to the following Terms and Conditions.

## 1. About Us

Binview Retreat is a private wellness venue located near Portsoy, Aberdeenshire, Scotland. We offer day-use wellness experiences including use of our sauna, cold plunge, hot tub and outdoor wellness facilities, together with occasional hosted wellness events.

Our retreat operates from our private family property. There is no overnight accommodation.

## 2. Bookings

All bookings are subject to availability.

Your booking is confirmed once you have completed the booking process, accepted these Terms & Conditions, completed the required Health Declaration and Participant Agreement, and received confirmation from us.

You must be at least 18 years old to make a booking.

Anyone under the age of 18 must be accompanied and supervised by a responsible adult unless otherwise agreed in writing.

## 3. Health Declaration

Before attending, all guests must complete our Health Declaration and Participant Agreement.

By completing these forms, you confirm that:

- The information you provide is accurate.
- You will inform us of any significant changes to your health before attending.
- You understand that sauna, cold water immersion and hot tub use may not be suitable for everyone.

If we believe participation may present a risk to your health or the safety of others, we reserve the right to refuse access.

## 4. Medical Conditions

You should not use the facilities if you:

- Have been advised against heat or cold exposure by a medical professional.
- Are under the influence of alcohol or recreational drugs.
- Have a contagious illness.
- Have any medical condition that makes participation unsafe.

If you are pregnant or have heart disease, uncontrolled high blood pressure, epilepsy, diabetes, respiratory conditions or any other significant medical condition, you should seek medical advice before attending.

## 5. Use of the Facilities

Guests use the facilities at their own risk.

You agree to:

- Follow all instructions provided by Binview Retreat staff.
- Follow all safety signage.
- Respect other guests.
- Use the facilities responsibly.
- Leave the site clean and tidy.

Running, diving, horseplay, aggressive behaviour or behaviour likely to endanger others is not permitted.

We reserve the right to ask anyone behaving in an unsafe or inappropriate manner to leave immediately without refund.

## 6. Personal Responsibility

Wellness activities involve inherent risks.

By attending, you acknowledge that:

- Heat exposure and cold-water immersion carry known risks.
- Participation is entirely voluntary.
- You are responsible for monitoring your own wellbeing throughout your visit.
- You should leave the sauna, hot tub or cold plunge immediately if you feel dizzy, faint, nauseous or unwell.

## 7. Alcohol and Drugs

Alcohol and illegal drugs are strictly prohibited.

Anyone believed to be under the influence may be refused entry or asked to leave immediately.

## 8. Cancellations

If you need to cancel, please let us know as soon as possible.

Where possible, we will try to transfer your booking to another session at our discretion.

If Binview Retreat needs to cancel due to severe weather, maintenance, safety concerns or unforeseen circumstances, we will offer an alternative booking or refund any payments made where applicable.

## 9. Donations and Payments

Some sessions may operate on a donation basis, while others may have a fixed booking fee.

Any suggested donation or booking fee will be clearly displayed before booking.

## 10. Personal Property

Guests are responsible for their own belongings.

Binview Retreat accepts no responsibility for loss, theft or damage to personal property.

## 11. Photography

Please respect the privacy of other guests.

Photography or filming of other guests is not permitted without their consent.

We may occasionally take promotional photographs or videos. We will always ask permission before using any identifiable images.

## 12. Parking

Parking is provided at your own risk.

Please use designated parking areas and follow any instructions provided.

## 13. Animals

Only assistance dogs are permitted unless agreed in advance.

## 14. Weather

Our facilities are outdoors and operate in most weather conditions.

We reserve the right to cancel sessions if weather conditions make it unsafe to operate.

## 15. Liability

Nothing in these Terms & Conditions excludes or limits liability for death or personal injury caused by negligence, fraud or any liability that cannot legally be excluded under UK law.

Subject to the above, Binview Retreat is not liable for indirect or consequential loss, damage to personal belongings or injury resulting from misuse of the facilities or failure to follow safety instructions.

## 16. External Event Hosts

Some sessions may be delivered by independent instructors or facilitators.

These instructors are responsible for their own activities and hold appropriate insurance.

Binview Retreat remains responsible for the venue and facilities.

## 17. Right to Refuse Entry

We reserve the right to refuse admission or remove any guest whose behaviour is unsafe, abusive, threatening or likely to affect the safety or enjoyment of others.

## 18. Privacy

Personal information is processed in accordance with our Privacy Policy and is used only for managing bookings, health and safety and legal obligations.

## 19. Governing Law

These Terms & Conditions are governed by the laws of Scotland.

Any disputes will be subject to the exclusive jurisdiction of the Scottish courts.

By making a booking and attending Binview Retreat, you confirm that you have read, understood and agree to these Terms & Conditions.

Please also ensure the online booking form includes a mandatory checkbox confirming guests have read and accepted the Terms & Conditions, Privacy Policy and Participant Agreement before completing their booking.
